1. Acceptance of Terms

By downloading, installing, or using the Face Off application ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of the App

Face Off is an AI-powered face-swap application that allows users to apply face-swap effects to images and videos using on-device machine learning models. The App offers a free trial period and subscription-based access to full features.

3. License

FXGear grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

You may not:

  • Copy, modify, distribute, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App or its components
  • Use the App or its components to train or develop competing products
  • Remove or alter any proprietary notices or labels in the App

4. User Responsibilities

4.1 Consent for Face Use

You are solely responsible for ensuring that any face used within the App — including faces of other people — is used with the explicit consent of the individual depicted. You must not use the App to process faces of others without their knowledge and consent.

4.2 Prohibited Uses

You agree not to use the App to:

  • Create or distribute non-consensual intimate imagery (NCII) or deepfake pornography
  • Impersonate any person for fraudulent, defamatory, or harmful purposes
  • Create content intended to harass, threaten, or harm any individual
  • Produce or distribute content that violates any applicable law or regulation
  • Spread misinformation or disinformation by fabricating realistic depictions of real people
  • Infringe upon the intellectual property, privacy, or likeness rights of any third party

4.3 Third-Party Likeness Claims

All content created by the App is processed and stored entirely on the user's device. FXGear does not store, host, or have access to any content created by users. As a result, FXGear is unable to remove, retrieve, or identify content on any user's device.

If you believe your likeness has been used without your consent and shared on a third-party platform, we recommend reporting it directly to that platform using their content reporting tools.

4.4 Age Requirement

You must be at least 17 years of age to use the App. The App is capable of generating realistic face-swap content, which may be misused to create deceptive or harmful material. By using the App, you represent that you are 17 years of age or older, or that you have obtained verifiable parental or guardian consent if required by the laws of your jurisdiction.

5. AI-Generated Content

Content produced by the App ("Output") is generated using AI models. All processing occurs entirely on your device; FXGear has no ability to access, monitor, review, or control any Output. You acknowledge that:

  • Output is generated based on inputs you provide and may not always be accurate or realistic.
  • You assume all legal responsibility for any Output you create, share, or distribute, including any consequences arising from its use by you or any third party.
  • You are solely responsible for ensuring that your use of Output complies with all applicable laws and regulations in your jurisdiction.
  • FXGear is not liable for any harm, legal claim, or loss arising from your use of Output, regardless of the nature of the claim (including but not limited to claims related to defamation, fraud, privacy, likeness rights, intellectual property infringement, or any other illegal or harmful use).

5.1 Disclosure Obligations (EU / EEA Users)

If you are located in the European Union or European Economic Area, you may be subject to disclosure obligations under the EU AI Act (Regulation (EU) 2024/1689), applicable from August 2026. In particular:

  • If you share or publish Output that depicts a real or realistic-looking person in a way that could falsely appear authentic (i.e., a deepfake), you must clearly disclose that the content is AI-generated or AI-manipulated.
  • This obligation applies when distributing Output through any platform, social media, or other media channel.

You are solely responsible for complying with applicable disclosure requirements in your jurisdiction. FXGear does not automatically add visible watermarks or labels to Output; labeling is your responsibility as the distributor of the content.

6. Intellectual Property

6.1 App and Its Components

All rights, title, and interest in the App, including its source code, proprietary components, graphics, and user interface, are owned by FXGear or its licensors. These Terms do not grant you any ownership rights.

6.2 Your Content

You retain ownership of any images and videos you provide as input to the App. By using the App, you represent that you have all necessary rights to use such content.

7. Subscriptions and Billing

7.1 Free Trial

The App may offer a free trial period. At the end of the free trial, your subscription will automatically begin unless you cancel before the trial period ends.

7.2 Subscription

Subscriptions are billed through Google Play on a recurring basis (e.g., monthly). You authorize Google Play to charge your payment method at the start of each billing cycle.

7.3 Cancellation

You may cancel your subscription at any time through your Google Play account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a subscription period.

7.4 Refunds

All billing and refund inquiries are handled by Google Play in accordance with the Google Play refund policy. FXGear does not process refunds directly.

7.5 Price Changes

FXGear reserves the right to change subscription pricing. You will be notified of any price changes before they take effect.

8. Third-Party Services

The App integrates with the following third-party services:

  • Google Play Billing: For subscription management and payment processing.
  • Google Play Asset Delivery: For downloading additional app data.
  • Firebase Analytics: For collecting anonymized usage statistics to improve the App. No personal content or biometric data is included in analytics events.
  • Built-in WebView: For accessing web content within the App. Third-party websites accessed via the WebView are subject to their own terms and privacy policies. FXGear is not responsible for the content or practices of third-party websites.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

FXGear does not warrant that:

  • The App will be error-free or uninterrupted
  • Processing results will meet your expectations
  • Processing results will be accurate or suitable for any specific purpose

10. Limitation of Liability

To the maximum extent permitted by applicable law, FXGear shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data or content
  • Any use, misuse, or distribution of Output by you or any third party
  • Damages arising from use of third-party content accessed via the WebView
  • Any claim by a third party arising from Output you created or distributed

FXGear's total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless FXGear, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or any content you create, share, or distribute using the App.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Termination

If you violate these Terms, your license to use the App is automatically revoked and you must cease all use of the App immediately. FXGear also reserves the right to revoke your subscription without refund in the event of a violation.

14. Changes to Terms

FXGear may update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. The "Last Updated" date at the top of this page indicates when the Terms were last revised.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in the Republic of Korea.

Notwithstanding the foregoing, nothing in these Terms limits or excludes any rights you may have under the mandatory laws of your country of residence that cannot be waived by contract. In particular:

  • European Union / EEA users: You may also benefit from any mandatory provisions of the law of your EU member state of residence, including rights under the General Data Protection Regulation (GDPR).
  • California users: You may have additional rights under the California Consumer Privacy Act (CCPA).
  • Other jurisdictions: Where local mandatory consumer protection laws apply, those laws will take precedence over these Terms to the extent of any conflict.

16. General Provisions

  • Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and FXGear regarding the use of the App.
